Terms of Service

Welcome to Transparency. These Terms of Service ("Terms") govern your use of the Transparency platform ("Service," "we," "us," or "our"). By using our Service, you agree to these Terms.

1. Acceptance of Terms

By subscribing to or using Transparency, you agree to be bound by these Terms of Service. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Transparency is a platform for accessing government transparency data. Features and available data sources may be added, modified, or removed at our discretion.

3. Government Data Sources and Compliance

Attribution and Data Sources

The Transparency platform uses data from government APIs including the OpenFEC API. Government data displayed in the Service is sourced from official government agencies through their public APIs.

Government agency names, logos, and data do not constitute an endorsement by any government agency of this Service or any product or service we provide.

3.1 Government Data Terms

By using this Service, you acknowledge and agree that your use of government data is subject to the applicable government agency's terms of service. You agree to:

  • Use government data only for lawful purposes
  • Not modify or misrepresent data obtained from government sources while claiming it originates from those sources
  • Understand that government data is provided "as is" without warranty of any kind
  • Comply with all applicable laws and regulations

3.2 Data Accuracy and Liability

The Service displays data as provided by government APIs. We do not modify, verify, or guarantee the accuracy of government data. Any questions about data accuracy should be directed to the relevant government agency.

4. User Requirements and API Keys

4.1 Government API Keys

To use the Service, you must obtain and provide your own API key(s) from the relevant government agencies (e.g., Data.gov). You are responsible for:

  • Obtaining required API keys from government sources
  • Maintaining the confidentiality of your API keys
  • Complying with the API provider's usage limits and policies
  • All activity that occurs using your API keys

4.2 License Key and Subscription

A valid subscription and license key are required to use the Service. Subscriptions may be free or paid depending on the features you access. You agree to:

  • Maintain an active subscription
  • Provide accurate account information
  • Pay applicable fees for paid subscription tiers, if any
  • Not share your license key with others
  • Use the Service only for your own purposes

5. Acceptable Use

You agree to use the Service only for lawful purposes. You may not:

  • Violate any applicable laws
  • Attempt to circumvent license validation or subscription requirements
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to harass, abuse, or harm others
  • Attempt to gain unauthorized access to our systems
  • Distribute, sell, or resell access to the Service
  • Use the Service in any way that could damage or impair our services

6. Subscription and Billing

6.1 Subscription Tiers

The Service requires a subscription. We offer both free and paid subscription tiers with different features. Paid subscription pricing may change with notice. By subscribing to a paid tier, you authorize us to charge your payment method on a recurring basis.

6.2 Payment Processing

Payments for paid tiers are processed through third-party payment processors. We do not store your credit card information.

6.3 Cancellation

You may cancel or downgrade your subscription at any time. Upon cancellation:

  • Paid subscriptions retain access until the end of the current billing period
  • No refunds are provided for the current billing period
  • Your access will adjust according to your new subscription tier

6.4 Subscription Changes

We may modify subscription tiers, features, and pricing at any time. Continued use after changes constitutes acceptance.

7. License Grant

Subject to your compliance with these Terms and maintenance of an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your own purposes. This license does not include the right to modify, distribute, sell, or sublicense the Service.

8. Privacy and Data Collection

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our data practices as described in the Privacy Policy.

9. Intellectual Property

The Service, including its code, design, features, and documentation, is owned by us and protected by intellectual property laws. Government data accessed through the Service is owned by the respective government agencies.

10. Disclaimers and Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We make no representations or warranties regarding the accuracy, completeness, or timeliness of any data. We do not guarantee that the Service will be available, error-free, or secure at all times.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Indemnification

You agree to indemnify and hold us harmless from any claims arising from your use of the Service or violation of these Terms.

13. Termination

Either party may terminate at any time. We may suspend or terminate your access for violation of these Terms or non-payment. Upon termination, your license ceases and you remain liable for any unpaid fees.

14. Changes to Terms

We may modify these Terms at any time. Continued use of the Service after changes constitutes acceptance. If you do not agree to changes, you must stop using the Service.

15. Governing Law

These Terms are governed by the laws of the United States. Disputes shall be resolved through binding arbitration or in courts of competent jurisdiction.

16. Miscellaneous

These Terms, together with our Privacy Policy, constitute the entire agreement. If any provision is unenforceable, the remaining provisions continue. You may not assign these Terms without our consent.

This Service facilitates access to public government data. We are not affiliated with, endorsed by, or sponsored by any government agency. Your use of government data is subject to the applicable government agency's terms and policies.
